Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Agent Hero website and services ("Services"). By using the Services, you agree to these Terms. If you're using the Services on behalf of a brokerage or business, you represent that you're authorized to accept these Terms for it.

1. Eligibility

You must be at least 18 and a licensed real estate professional (or acting under one's authority) to use the Services for real estate activities. You're responsible for keeping your account credentials secure.

2. The Services

Agent Hero provides custom AI agents and related tools for real estate professionals. The Services are actively developed; features, integrations, and pricing may change as the product evolves. Some features depend on third-party tools you connect (e.g., MLS, CRM, calendar, messaging, ad platforms), and your use of those tools is governed by their own terms.

3. Your Responsibilities

• You direct what your agent does and are responsible for its actions taken on your behalf, including messages it sends and tasks it performs.
• You will comply with all applicable laws and professional rules — including fair housing, real estate licensing and advertising rules, MLS and brokerage policies, and communications laws such as TCPA and CAN-SPAM.
• You will obtain any required consents — including consent to contact leads and clients, and consent to create and use a cloned voice — and you will honor opt-out requests.
• You will review the agent's outputs before relying on them and keep a human in the loop for anything requiring licensed judgment or sign-off.

4. AI Outputs

The Services use AI, which can be inaccurate or incomplete. Outputs (including comps, market figures, drafts, and listing content) are for assistance only, are not guaranteed to be accurate, and are not legal, tax, financial, or professional advice. You are responsible for verifying information before using or sharing it.

5. Fees & Billing

Paid plans (for example, Solo at $499/month) and any one-time startup fee are billed as described at sign-up. Fees are exclusive of taxes. Subscriptions renew monthly until cancelled. You can cancel anytime and your plan will run through the end of the current billing period; except where required by law, fees already paid are non-refundable.

6. Acceptable Use

Don't use the Services to break the law, infringe others' rights, send spam or unlawful messages, impersonate someone without authorization, or attempt to disrupt or reverse-engineer the platform.

7. Intellectual Property

We own the Services, software, and our brand. You own your data and content. You grant us the rights needed to operate the Services for you (for example, to process your data and connected-tool content to perform tasks you delegate). Feedback you share may be used to improve the Services.

8. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We don't guarantee specific results, listings won, uptime, or that the Services will be error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Agent Hero will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Services is limited to the amounts you paid us in the three months before the claim.

10. Indemnification

You agree to indemnify and hold Agent Hero harmless from claims arising out of your use of the Services, your content or clients' data, or your failure to comply with law or these Terms.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or to protect the Services. On termination, your right to use the Services ends; sections that by their nature should survive will survive.

12. Changes

We may update these Terms from time to time. We'll update the "last updated" date and, for material changes, provide reasonable notice. Continued use after changes means you accept them.

13. Governing Law

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules.
